The City of Glendale and various other parties sought to set aside the Department of the Interior's decision to accept in trust, for the benefit of the Tohono O'odham Nation, a 54-acre parcel of land known as Parcel 2. The Nation hoped to build a destination resort and casino on Parcel 2, which was unincorporated county land, entirely surrounded by the city. This appeal related the the status of the land as trust. The court affirmed the district court's grant of summary judgment for the government after that court concluded that the Secretary of the Interior reasonably applied the Gila Bend Indian Reservation Lands Replacement Act, Pub. Petitioner requested that the Secretary of the Interior take into trust on its behalf a tract of land known as the Bradley Property, which petitioner intended to use "for gaming purposes." The Secretary took title to the property and respondent subsequently filed suit under the Administrative Procedures Act (APA), 5 U.S.C. 500 et seq., asserting that the Indian Reorganization Act (IRA), 25 U.S.C. 465, did not authorize the Secretary to acquire the property because petitioner was not a federally recognized tribe when the IRA was enacted in 1934. At issue was whether the United States had sovereign immunity from the suit by virtue of the Quiet Title Act (QTA), 86 Stat. 1176, and whether respondent had prudential standing to challenge the Secretary's acquisition. The Court held that the United States had waived its sovereign immunity from respondent's action under the QTA. The Court also held that respondent had prudential standing to challenge the Secretary's acquisition where respondent's interests came within section 465's regulatory ambit. The State challenged the Secretary's decision to accept four parcels of land within the geographic boundaries of the State into trust for the benefit of the Sisseton-Wahpeton Oyate of the Lake Traverse Reservation, a federally recognized Indian tribe. The district court granted summary judgment in favor of the Secretary and the State appealed. The court held that, because the State lacked standing to bring a constitutional due process claim and did not raise any additional arguments on appeal, the State was not entitled to relief. The Buena Vista Rancheria of Me-Wuk Indians ("Buena Vista") entered into a compact with California to engage in gaming on its tribal land and then petitioned the Secretary of the Interior ("Secretary") for approval of the compact. Amador County, in which Buena Vista's land was located, challenged the Secretary's "no-action" approval claiming that the land at issue failed to qualify as "Indian land." At issue was whether Amador County lacked constitutional standing to maintain the suit and whether a compact, that was deemed approved where he failed to act within the 45 day limit, was reviewable. The court held that Amador County had standing where its allegations were more than sufficient to establish concrete and particularized harm and where Amador County could easily satisfy the requirements of causation and redressability. The court also held that where, as here, a plaintiff alleged that a compact violated the Indian Gaming Regulatory Act ("IGRA"), 25 U.S.C. 2710(d)(8)(C), and required the Secretary to disapprove the compact, nothing in the Administrative Procedures Act, 5 U.S.C. 701(a)(2), precluded judicial review of a subsection (d)(8)(C) no-action approval. Accordingly, the court remanded to give the district court the opportunity to assess the merits of the suit.

A 1935 settlement gives the tribe specific irrigation rights in the Gila River. The government filed another water rights claim on behalf of the tribe in 1979, resulting in a 2006 Arizona Supreme Court decree that the 1935 decree resolved all of the tribe's rights under all theories and that federal court was the proper forum for interpretation and enforcement of that decree. The Court of Federal Claims dismissed a claim against the United States for failure to secure and protect the tribe's water rights. The Federal Circuit affirmed, finding the claim barred by the six-year limitations period in 28 U.S.C. 2501. Rejecting an argument that the tribe was not on notice of its harm until the 2006 decision, the court stated that the plain terms of the 1935 decree indicated that the tribe would have no further rights and that the government was representing multiple parties.
