Mustang Run Wind Project, LLC, (Mustang) filed an application with the Osage County Board of Adjustment for a conditional use permit involving approximately 9,500 acres of land. Mustang proposed to use the land for placing sixty-eight wind turbines on less than 150 acres and generating electricity. Public meetings on the proposed wind energy facility were held in April and May 2014. The proposed facility was close to another "wind farm" which had obtained a permit three years previously. Mustang's application included land zoned for agricultural use and was then being used for agriculture and ranching. The County Board of Adjustment denied the application. A trial de novo was held and the trial court ordered the County Board of Adjustment to issue a conditional use permit. The Osage County Board of Adjustment and the Osage Nation appealed to the Oklahoma Supreme Court. After review, the Supreme Court held that the Osage County Board of Adjustment possessed authority to grant conditional use permits, but the trial judge's findings were not against the clear weight of the evidence. Accordingly, the Court affirmed the trial court's judgment requiring the Board of Adjustment to issue a conditional use permit with any additional reasonable conditions. In 2002 the Enterprise Rancheria of Maidu Indians of California (Enterprise Tribe) submitted a request to the United States Department of the Interior (Department) to acquire a site in Yuba County for the purpose of establishing a casino/hotel resort complex. Pursuant to statute, the Secretary was authorized to acquire land, within or without an existing reservation, for the purpose of providing land for Indians. Land so acquired after October 17, 1988, could not, with some exceptions, be used for gaming. The exception at issue here was where the Secretary “after consultation with the Indian tribe and appropriate State and local officials, including officials of other nearby Indian tribes, determines that a gaming establishment on newly acquired lands would be in the best interest of the Indian tribe and its members, and would not be detrimental to the surrounding community, but only if the Governor of the State in which the gaming activity is to be conducted concurs in the Secretary’s determination.” The Governor indicated his official concurrence with the Assistant Secretary’s determination. Plaintiff Auburn Tribe owned and operated the Thunder Valley Resort and Casino, approximately 20 miles from the Yuba County site. The Auburn Tribe filed a petition for writ of mandate and complaint for declaratory relief, alleging: (1) the Governor was required to comply with California Environmental Quality Act (CEQA) before concurring in the Secretary’s decision to take lands into trust for the Enterprise Tribe; and (2) the Governor performed a legislative act when he concurred with the Secretary and when he negotiated and executed the compact with the Enterprise Tribe, in violation of the constitutional mandate of separation of powers. After review, the Court of Appeals concluded the CEQA did not apply here, and that the Governor’s concurrence did not violate the separation of powers clause. Accordingly, the Court affirmed. In 1854, the Omaha Tribe entered into a treaty with the United States to establish a 300,000-acre reservation and to “cede” and “forever relinquish all right and title to” its remaining land in present-day Nebraska for a fixed price. In 1865, the Tribe entered into another treaty, agreeing to sell land to the government for a fixed sum. In 1872, the Tribe sought to sell more land. Instead of a fixed-sum purchase, Congress authorized the Secretary of the Interior to survey, appraise, and sell tracts of reservation land to settlers and to deposit proceeds with the Treasury for the Tribe’s benefit. Congress took the same approach in 1882 with respect to roughly 50,000 acres of reservation land (22 Stat. 341). Peebles purchased land under the terms of the 1882 Act and established the village of Pender. In 2006, the Tribe sought to subject Pender retailers to tits amended beverage control ordinance pursuant to 18 U.S.C. 1161 (permitting tribes to regulate liquor sales on reservation land and in “Indian country”). Concluding that the 1882 Act did not diminish the Reservation, the district court ruled in favor of the Tribe. The Eighth Circuit and Supreme Court affirmed. Only Congress may diminish the boundaries of an Indian reservation, and its intent to do so must be clear. The 1882 Act had none of the common textual indications that express clear intent, but falls into a category of surplus land acts that “merely opened reservation land to settlement.” Although the Tribe has been absent from the disputed territory for more than 120 years, the Court stated that subsequent demographic history is the “least compelling” evidence; the justifiable expectations of non-Indians living on the land cannot alone diminish reservation boundaries. In 2005, the Shinnecock Indian Nation filed suit to vindicate its rights to land in the Town of Southampton, claiming that 1859 New York legislation allowed thousands of acres of the Nation’s land to be wrongfully conveyed to the town. The district court dismissed, holding that laches barred the claims. An appeal to the Second Circuit remains pending. In 2012, the Nation filed suit in the Court of Federal Claims, seeking $1,105,000,000, alleging that the United States, “acting through the federal court system . . . denied any and all judicial means of effective redress for the unlawful taking of lands” in violation of trust obligations arising under the Non-Intercourse Act, 25 U.S.C. 177, and the “federal common law.” The Claims Court dismissed on alternative grounds: that the claims were not ripe because they were predicated upon the district court’s judgment in the prior suit, which was on appeal, or that, even if the claims were ripe, it had no jurisdiction because they did not fall within the Indian Tucker Act’s waiver of sovereign immunity. The court refused to allow amendment to allege a judicial takings claim. The Federal Circuit affirmed that the breach of trust claims are not ripe for review, vacated the jurisdiction ruling, and remanded with instructions to dismiss the breach of trust claims without prejudice. A 1991 judgment, not appealed, upheld a state statute prohibiting members of the Indian tribes from hunting deer at night outside the tribes’ reservations. Wisconsin Indians had hunted deer at night since before they had electricity. Tribe members sought relief from the judgment under Fed. R. Civ. P. 60(b)(5) on the ground that its continued enforcement would be “no longer equitable” and asserting that “tribal members need to hunt for subsistence purposes. Between 25% and 93% of Tribal members are unemployed. They also claimed that “tribal members need to hunt at night for cultural and religious reasons.” The district court denied the motion, precipitating this appeal. The Seventh Circuit reversed, noting that neighboring states allow night hunting; that the state has stringent regulations; and concerns about Indian cultural and dietary practices relating to deer hunting, poverty, and unemployment. Evidence presented by the tribes indicated that night hunting for deer in the identified territory is unlikely to create a serious safety problem. This appeal arose from a proceeding brought by the Klallam under the continuing jurisdiction of a 1974 decree issued by the U.S. District Court for the Western District of Washington, and it involved a dispute over the geographic scope of the Lummi's "usual and accustomed fishing grounds." The court held that the law of the case doctrine applies only when the issue was decided explicitly or by necessary implication in the previous disposition. In this case, the court held that no prior decision has yet explicitly or by necessary implication determined whether the waters immediately west of northern Whidbey Island are a part of the Lummi's usual and accustomed fishing grounds. Therefore, the district court erred in concluding that the issue was controlled by law of the case and the court reversed the grant of Klallam's motion for summary judgment, remanding for further proceedings. The issue before the Supreme Court in this case involved the validity of an amended rule from the Department of Ecology that reserved water from the Skagit River system for future year-round out-of-stream uses, despite the fact that in times of low stream flows these uses would impair established minimum in-stream flows necessary for fish, wildlife, recreation, navigation, scenic and aesthetic values. The Swinomish Indian Tribal Community (Tribe) sued, challenging the validity of Ecology's amended rule reserving the water. The trial court upheld the amended rule and dismissed the Tribe's petition. After its review, the Supreme Court concluded that Ecology erroneously interpreted the statutory exception as broad authority to reallocate water for new beneficial uses when the requirements for appropriating water for these uses otherwise cannot be met. "The exception is very narrow, however, and requires extraordinary circumstances before the minimum flow water right can be impaired." Because the amended rule exceeded Ecology's authority under the statute, the amended rule reserving the water was invalid under the Administrative Procedure Act (APA). McGuire leased farmland in Arizona from the Colorado River Indian Tribes with approval of the Bureau of Indian Affairs. After the BIA removed a bridge that he used to access portions of the leased property, McGuire filed a Fifth Amendment claim. McGuire does not claim that removal of the bridge was itself a taking, but rather that the BIA’s alleged refusal to authorize replacement of the bridge was a taking of his property rights. The Court of Federal Claims rejected the claim. The Federal Circuit affirmed, holding that the regulatory takings claim never ripened because McGuire failed to pursue administrative remedies. Even if McGuire’s claim had ripened, he had no cognizable property interest in the bridge, which he neither possessed nor controlled because it was in a BIA right-of-way. No federal regulation gave him a property interest and he was not entitled to an easement by necessity. View "McGuire v. United States" on Justia Law

Petitioner requested that the Secretary of the Interior take into trust on its behalf a tract of land known as the Bradley Property, which petitioner intended to use "for gaming purposes." The Secretary took title to the property and respondent subsequently filed suit under the Administrative Procedures Act (APA), 5 U.S.C. 500 et seq., asserting that the Indian Reorganization Act (IRA), 25 U.S.C. 465, did not authorize the Secretary to acquire the property because petitioner was not a federally recognized tribe when the IRA was enacted in 1934. At issue was whether the United States had sovereign immunity from the suit by virtue of the Quiet Title Act (QTA), 86 Stat. 1176, and whether respondent had prudential standing to challenge the Secretary's acquisition. The Court held that the United States had waived its sovereign immunity from respondent's action under the QTA. The Court also held that respondent had prudential standing to challenge the Secretary's acquisition where respondent's interests came within section 465's regulatory ambit.
