The Tenth Circuit considered whether the Bureau of Indian Affairs (BIA) properly exercised its discretion to reject a gift of property by a member of the Miami Tribe of Oklahoma to the tribe. The Court noted that this appeal also raised a novel jurisdictional question regarding its review of administrative decisions following a remand from district court. James Smith wanted to transfer to the tribe a portion of his property interest in the Maria Christiana Reserve No. 35 (southwest of Kansas City) where the tribe had plans to develop gaming facilities. Federal law and restrictions on Smith’s fee interest required the BIA to approve any transfer. Citing concerns regarding fractional land interests in the Reserve as well as the long-range best interests of Reserve landowners, the BIA denied Smith’s application to transfer the land. The Tribe challenged that decision. Upon review, the Tenth Circuit held the BIA properly exercised its discretion in denying the application. With regard to the jurisdictional question raised, the Court concluded that the government has not abandoned its right to challenge the district court’s remand order, even though the government substantially prevailed in the district court’s final judgment. The Court found the district court erred in its remand order reversing the BIA’s denial of Smith’s application. Therefore the Court vacated the district court’s final judgment and its order reversing the BIA, and remanded the case for further consideration of Smith’s application consistent with this opinion. Defendant was convicted of one count of arson for setting fire to his home on the Rosebud Indian Reservation. Defendant appealed the restitution order contending that the district court erred in awarding restitution to the two organizations that had provided emergency funds to the victims without reducing the amount of restitution owed to the victims personally. Defendant also contended that the district court further erred in using the replacement cost to determine the value of the homeowner's loss. The court held that the district court erred in awarding full restitution to the family for their personal property losses while also awarding restitution to the Red Cross and the Bureau of Indian Affairs for the amount of funds each provided to the family. The court also held that the district court erred in calculating Sicangu Wicoti Awanyakapi Corporation's actual loss to be the replacement cost of the destroyed home and in failing to account for its retention of defendant's Monthly Equity Payment Account. Plaintiff appealed the dismissal for lack of subject matter jurisdiction of its action against defendant, alleging tort, contract, and state statutory claims and seeking, among other remedies, a constructive trust and declaratory judgment over an oil and gas lease located on allotted land, wherein title to the land was held by the United States in trust for various Indian allottees. At issue was whether the district court had federal jurisdiction. The court held that 28 U.S.C. 1360(b), 28 U.S.C. 1331, and 25 U.S.C. 345 did not grant federal jurisdiction and therefore, plaintiff presented no basis for concluding that the action was within the "limited jurisdiction" of federal courts. Accordingly, the district court properly dismissed the suit based on lack of subject matter jurisdiction and the court did not need to reach any other issues raised by the parties, including exhaustion of tribal remedies. The Jicarilla Apache Nation's ("Tribe") reservation contained natural resources that were developed pursuant to statutes administered by the Interior Department and proceeds from these resources were held by the United States in trust for the Tribe. The Tribe filed a breach-of-trust action in the Court of Federal Claims ("CFC") seeking monetary damages for the Government's alleged mismanagement of the Tribe's trust funds in violation of 25 U.S.C. 161-162a and other laws. During discovery, the Tribe moved to compel production of certain documents and the Government agreed to the release of some documents but asserted that others were protected by, inter alia, the attorney-client privilege. At issue was whether the fiduciary exception to the attorney-client privilege applied to the general trust relationship between the United States and Indian tribes. The Court held that the fiduciary exception did not apply where the trust obligations of the United States to the Indian tribes were established and governed by statute rather than the common law and, in fulfilling its statutory duties, the Government acted not as a private trustee but pursuant to its sovereign interest in the execution of federal law. The reasons for the fiduciary exception, that the trustee had no independent interest in trust administration, and that the trustee was subject to a general common-law duty of disclosure, did not apply in this context. This case arose when the Colorado River Indian Tribes ("CRIT") exercised jurisdiction over appellants, a non-Indian closely held corporation and its non-Indian owner, in an unlawful detainer action for breach of a lease of tribal lands and trespass. The tribal court entered judgment in favor of the tribe and appellants appealed. At issue was the extent of the CRIT's civil authority over appellants who were acting on tribal land within the reservation. The court held that under the circumstances presented, where there were no sufficient competing state interests at play, the tribe had regulatory jurisdiction through its inherent authority to exclude, independent from the power recognized in Montana v. United States. The court also held that adjudicative jurisdiction also existed in light of Supreme Court precedent recognizing tribes' inherent civil authority over non-Indian conduct on tribal land and congressional interest in promoting tribal self-government. The court further held that in this instance, by applying traditional personal jurisdiction principles, the tribal court had personal jurisdiction over a non-Indian agent acting on tribal land. Accordingly, the court affirmed the district court's judgment as to the non-Indian corporation and reversed with respect to the non-Indian owner. View "Water Wheel Camp Recreational, et al. v. Appellants appealed the order of the district court denying their motion to dismiss for lack of subject matter jurisdiction over the estate of their father, the decedent. At issue was whether the district court erred when it assumed subject matter jurisdiction over the probate of the estate when the decedent was an enrolled member of the Blackfeet Tribe and all of his estate property was located within the exterior boundaries of the Blackfeet Reservation at the time of his death. The court overruled State ex rel. Iron Bear v. District Court and held that the Blackfeet Tribal Court had exclusive jurisdiction over the probate of the decedent's estate and assumption of subject matter jurisdiction by the district court was impermissible because Montana and the Blackfeet Tribe had not taken the necessary steps for Montana to assume civil jurisdiction over the Blackfeet Reservation.

Hollywood Mobile Estates Limited ("Hollywood") filed a complaint in district court against the Seminole Tribe of Florida ("Tribe") where the Tribe and the Secretary of the Interior ("Secretary") approved a lease assignment between Hollywood and the Tribe. At issue was whether Hollywood alleged an injury fairly traceable to the Secretary or redressable by the district court in a complaint that alleged that the Tribe had threatened to repossess tribal property in violation of the lease. Also at issue was whether the interests of Hollywood were within the zone of interests protected by the Indian Long-Term Leasing Act, 25 U.S.C. 415, and its accompanying regulations. The court held that Hollywood lacked constitutional standing to maintain its complaint and therefore, vacated in part the judgment entered by the district court and remanded with instructions to dismiss for lack of subject matter jurisdiction. The court also held that Hollywood lacked prudential standing to sue the Secretary and therefore, affirmed the denial of the motion for leave to amend the complaint as futile.
