In 2015, Wichita and affiliated tribes made plans to build a History Center on a plot of land held by the federal government in trust for the Wichita Tribe, Delaware Nation, and Caddo Nation jointly. One of those neighbors, the Caddo Nation, claimed the land may contain remains of ancestral relatives. Before the Wichita Tribe began construction, Caddo Nation sued the Wichita Tribe for allegedly violating the procedures required by the National Historic Preservation Act (NHPA) and the National Environmental Policy Act (NEPA) throughout the planning process. Caddo Nation sought an emergency temporary restraining order preventing Wichita Tribe from continuing construction until it complied with those procedures. When the district court denied that request, Caddo Nation appealed to the Tenth Circuit Court of Appeals without seeking further preliminary relief. In the intervening year while the case was on appeal with the Tenth Circuit, Wichita Tribe completed construction of the History Center. The Tenth Circuit concluded it had no jurisdiction over this appeal because the relief Caddo Nation requested from the district court was moot. View "Caddo Nation of Oklahoma v. The Supreme Court rejected a challenge to the constitutionality of the Confederated Salish and Kootenai Water Compact, holding that Mont. Const. art. II, section 18 did not require the Montana Legislature to approve the Compact or its administrative provisions.The Compact, negotiated between the Confederated Salish and Kootenai Tribes, provided a unified system for the administration of water rights and the resolution of disputes on the reservation. The Compact was approved by the Montana Legislature in 2015. The Flathead Board of Joint Control brought suit against the State seeking to invalidate the Compact. The district court ruled (1) the challenged section of the Compact did not contravene Article II, Section 18 because it did not enact any new immunities from suit; but (2) the challenged section of the administrative provision provided new immunity to the State and, therefore, was covered by Article II, Section 18, and because the provision did not pass by a two-thirds majority of each house, it is unconstitutional. The Supreme Court reversed in part, holding (1) none of the Compact’s provisions grant any state governmental agency new immunities from a potential lawsuit; and (2) the Legislature’s majority vote to approve and adopt the contract was consistent with subject provisions of the Montana Constitution. Kenneth and Donna Johnson appealed a district court judgment recognizing a tribal judgment from the Coeur d’Alene Tribal Court (Tribal Court). The Johnsons owned land within the Coeur d’Alene Reservation (Reservation) on the banks of the St. Joe River and had a dock and pilings on the river. The Coeur d’Alene Tribe (Tribe) initiated an action in Tribal Court to enforce a tribal statute which required a permit for docks on the St. Joe River within the Reservation. The Johnsons did not appear and a default judgment was entered against them. The judgment imposed a civil penalty of $17,400 and declared that the Tribe was entitled to remove the dock and pilings. On January 2016, the Tribe filed a petition to have the Tribal Court judgment recognized in Idaho pursuant to the Enforcement of Foreign Judgments Act. I.C. sections 10-1301, et seq. The district court held the Tribal Judgment was valid and enforceable, entitled to full faith and credit. However, the Idaho Supreme Court determined the district court was incorrect in holding the Tribal Judgment was entitled to full faith and credit, and the civil penalty was not entitled to recognition in Idaho courts. However, the Idaho Supreme Court held the Tribal Court had jurisdiction over the Johnsons and the subject matter of this case; the Johnsons did not meet their burden of establishing the Tribal Court did not have jurisdiction, and the Johnsons were afforded due process in Tribal Court. In this case the judgment comprised two parts: (1) the civil penalty of $17,400; and (2) the declaration that the Tribe had the right to remove the offending encroachment. The civil penalty was not enforceable under principles of comity. However, the penal law rule does not prevent courts from recognizing declaratory judgments of foreign courts. Therefore, the Idaho Supreme Court vacated the district court’s judgment to the extent that it recognized the Tribal Court’s judgment imposing the civil penalty of $17,400. In cases consolidated for review, the issue presented for the Tenth Circuit centered on whether the Bureau of Land Management (BLM) acted beyond its statutory authority when it promulgated a regulation, 43 C.F.R. sec. 3162.3-3 (2015), governing hydraulic fracturing (fracking) on lands owned or held in trust by the United States. The district court invalidated this regulation as exceeding the BLM’s statutory authority. While these appeals were pending, a new President of the United States was elected, and shortly thereafter, at the President’s direction, the BLM began the process of rescinding the Fracking Regulation. Given these changed and changing circumstances, the Tenth Circuit concluded these appeals were unripe for review. As a result, the Court dismissed these appeals and remanded with directions to vacate the district court’s opinion and dismiss the action without prejudice. View "Wyoming v. Zinke" on Justia Law

The Supreme Court reversed the water court’s denial of Scott Ranch LLC’s petition for adjudication of existing water rights appurtenant to Indian allotment lands it acquired that were previously held in trust by the United States for the benefit of a member of the Apsaalooke (Crow) Tribe. After that member died and the lands were converted to fee status, Scott Ranch filed its petition. In denying the petition, the water court ruled that the lands were part of the Tribal Water Right established by the Crow Water Rights Compact and did not require a separate adjudication. The Supreme Court disagreed, holding that the water court lacked jurisdiction to adjudicate Scott Ranch’s claims and erroneously proceeded to address the merits of the petition. Unable to win the consent of all necessary landowners, a public utility company contended it had a statutory right to condemn a right-of-way on two parcels of land in New Mexico. Because federal law did not permit condemnation of tribal land, the Navajo Nation’s ownership of undivided fractional interests in the parcels presented a problem for the company. The Tenth Circuit affirmed the district court’s dismissal of the condemnation action against the two land parcels in which the Navajo Nation held an interest. View "Public Service Company of NM v. Plaintiffs-Appellants, a certified class of Osage tribal members who owned headrights, appealed the district court’s accounting order. Plaintiffs alleged that the government was improperly distributing royalties to non-Osage tribal members, which diluted the royalties for the Osage tribal members, the rightful headright owners. The complaint attributed this misdistribution to the government’s mismanagement of the trust assets and the government’s failure to perform an accounting. Thus, Plaintiffs sought to compel the government to perform an accounting and to prospectively restrict royalty payments to Osage tribal members and their heirs. The district court dismissed Plaintiffs’ accounting claim because it found that the applicable statute only required the government to account for deposits, not withdrawals, and that such an accounting would not support Plaintiffs’ misdistribution claim. After review, the Tenth Circuit could not say the district court abused its discretion. The Eastern Shoshone and Northern Arapaho Tribes jointly inhabited the Wind River Reservation. The State of Wyoming and the Wyoming Farm Bureau Federation challenged a decision by the Environmental Protection Agency granting the Tribes’ application for joint authority to administer certain non-regulatory programs under the Clean Air Act on the Reservation. As part of their application, the Tribes were required to show they possessed jurisdiction over the relevant land. The Tribes described the boundaries of the Wind River Reservation and asserted that most of the land within the original 1868 boundaries fell within their jurisdiction. Wyoming and others submitted comments to the EPA arguing the Reservation had been diminished in 1905 by act of Congress, and that some land described in the application was no longer within tribal jurisdiction. After review, the EPA determined the Reservation had not been diminished in 1905 and the Tribes retained jurisdiction over the land at issue. Because the EPA decided the Tribes otherwise satisfied Clean Air Act program requirements, it granted their application. The issue this case presented for the Tenth Circuit's review was whether Congress diminished the boundaries of the Wind River Reservation in Wyoming in 1905. the Court found that it did. The issue this case presented for the Supreme Court’s review was whether the Upper Skagit Indian Tribe's (Tribe) assertion of sovereign immunity requires dismissal of an in rem adverse possession action to quiet title to a disputed strip of land on the boundary of property purchased by the Tribe. The superior court concluded that because it had in rem jurisdiction, it could determine ownership of the land without the Tribe's participation. An inquiry under CR 19, involved a merit-based determination that some interest will be adversely affected in the litigation. Where no interest is found to exist, especially in an in rem proceeding, nonjoinder presents no jurisdictional barriers. The Supreme Court found that the Tribe did not have an interest in the disputed property; therefore, the Tribe's sovereign immunity was no barrier to this in rem proceeding. Thirty years ago, the Tenth Circuit decided all boundary disputes between the Ute Indian Tribe, the State of Utah, and its subdivisions. The only thing that remained was for the district court to memorialize that mandate in a permanent injunction. Twenty years ago, the Court modified its mandate in one respect, but stressed that in all others, the Court's earlier decision remained in place. The matter came before the Tenth Circuit again: the State of Utah, one of its cities, and several of its counties sought to relitigate the same boundaries. "Over the last forty years the questions haven’t changed - and neither have our answers." This case and all related matters were reassigned to a different district judge. The court and parties were directed to proceed to a final disposition both promptly and consistently with the Tenth Circuit's mandates in "Ute V," "Ute VI," and this case.
