The First Circuit affirmed the decision of the Department of the Interior's Bureau of Indian Affairs (BIA) to take two parcels of land in Massachusetts into trust for the Mashpee Wampanoag Indian Tribe, holding that the BIA's application of its legal interpretation to the facts was not arbitrary, capricious, an abuse of discretion, or otherwise not in accordance with law.Appellants brought this action challenging the Interior's 2021 record of decision reaffirming its 2015 decision to take the land into trust for the Tribe, arguing that the Tribe did not qualify as a "tribe" within the meaning of the Indian Reorganization Act, that the Tribe was not "under Federal jurisdiction," and that the parcel of land was not eligible activities under the Indian Gaming Regulatory Act. The district court granted summary judgment for the Interior and the Tribe. The First Circuit affirmed, holding that Appellants were not entitled to relief on any of their allegations of error. Defendant-appellant Kenneth Walker appealed his conviction and sentence for assault resulting in serious bodily injury within Indian country. Walker lived "off and on" with his adult niece, Victoria Dirickson. Walker asked Dirickson for a set of house keys. She declined because “[i]t was [her] only day off, and [she] really didn’t feel like getting out and making a copy” of the keys. Walker became “[r]eally aggravated,” and an argument ensued in the living room, which lead to the assault charges at issue in this case. A grand jury indicted Walker on one count of assault resulting in serious bodily injury within Indian country. The indictment alleged Walker was a non-Indian and Dirickson was Indian. A jury found Walker guilty as charged. On appeal, Walker: (1) challenged the district court's jurisdiction because it erred in admitting Dirickson's Certificate of Degree of Indian Blood (“CDIB”) and tribal registration cards; (2) the district court abused its discretion in admitting the testimony of a medical expert; (3) the district court abused its discretion in failing to give a unanimity-of-means jury instruction; (4) abused its discretion in failing to consider sentencing disparities arising from a possible sentence in a state case; and (5) Plainly erred in imposing an anger management condition of supervised release due to insufficient notice, and improper delegation of authority to the Probation Office. Finding no reversible error, the Tenth Circuit affirmed Walker's conviction and sentence. View "United States v. Walker" on Justia Law

The Supreme Court reversed in part and affirmed in part the judgment of the district court in favor of Baldwin, Crocker & Rudd, P.C. and Kelly Rudd (collectively, BCR) in this action brought by the Northern Arapaho Tribe and the Wind River Hotel & Casino (collectively, the Tribe), holding that the district court's order imposing sanctions on the Tribe was erroneous.The Tribe brought this action seeking injunctions for the return of tribal funds and documents, an accounting, and damages for conversion and civil theft. The district court granted summary judgment for BCR on the accounting and injunctions claims and, after a jury trial, entered final judgment on the conversion and civil theft claim. The Tribe appealed, arguing, among other things, that the district court erred by awarding sanctions under Wyo. R. Civ. P. 11. The Supreme Court reversed in part, holding that (1) the district court erred in imposing sanctions because BCR failed to comply with the procedural requirements of Rule 11; (2) the district court did not err when it granted summary judgment for BCR on the Tribe's accounting claim; and (3) the Tribe failed to show the verdict would have been more favorable if racially charged evidence had not been admitted. The Northwestern Band of the Shoshone Nation filed a complaint against Idaho state officials concerning the interpretation of the 1868 Treaty of Fort Bridger between the United States and several bands of the Shoshone and Bannock Tribes, including the Shoshone’s Northwestern Band. Under the Treaty, the affiliated Shoshone and Bannock Tribes ceded most of their territory to the United States. At the same time, the Tribes expressly reserved their right to hunt on unoccupied lands of the United States. Idaho officials contend that the Treaty conditions the reserved hunting right on permanent residence on a designated reservation and that Northwestern Band members may not exercise the Tribes’ treaty-reserved hunting right because the Northwest Band does not reside on a designated reservation. The district court agreed with Defendants’ treaty interpretation. The only issue on appeal is whether the district court erred in concluding that the Treaty makes the reserved hunting right contingent on permanent residence on the Fort Hall or Wind River Reservations.   The Ninth Circuit reversed the district court’s judgment. The panel held that the Treaty’s terms, which must be read in context and construed as they would naturally be understood by the Tribes, plainly do not condition the exercise of the reserved hunting right on the Northwestern Band relocating to a reservation. Because the district court did not reach the Idaho officials’ alternative arguments regarding political cohesion and necessary joinder, the panel remanded the case for the district court to address those issues in the first instance. Appellant R.L., presumed father (father) of minor C.L. (the minor), appealed the juvenile court’s order terminating father’s parental rights and freeing the minor for adoption. The minor was removed from his parents through a protective custody warrant under Welfare and Institutions Code section 340. Father contended the Amador County Department of Social Services (the department) failed to comply with the initial inquiry requirements of California law implementing the Indian Child Welfare Act of 1978 (ICWA) because the department did not inquire of extended family members as to the minor’s Indian ancestry when he was removed. The Court of Appeal agreed with father and held that the duty to inquire of extended family members applied when removal is made via a section 340 protective custody warrant. Because the department failed to comply with this duty, remand was required. Remand was also required because father stated that his great-grandmother was full-blooded Cherokee at the detention hearing, triggering a duty of further inquiry into the minor’s Indian ancestry. This further inquiry duty was not satisfied. The Court therefore conditionally reversed the order terminating parental rights. View "In re C.L." on Justia Law

Defendant’s mother called local dispatch and said an officer needed to come by because her son was “acting up.” A Bureau of Indian Affairs Officer was dispatched to the home, learning on the way that Defendant had an active tribal arrest warrant. Defendant’s mother invited Defendant into the living room and told Defendant to join them. The officer told Defendant he was “going to have to take you because you got that warrant.” Defendant fled to the garage, pursued by the officer, where Defendant knocked the officer down and escaped. Defendant was charged with forcibly assaulting, resisting, opposing, impeding, intimidating, or interfering with a federal officer and inflicting bodily injury. The jury convicted him of the lesser included offense of forcible assault of a federal officer involving physical contact. The district court sentenced Defendant to 44 months’ imprisonment. He appealed, raising numerous evidentiary issues and challenging the assessment of a two-level sentencing increase.
The Eighth Circuit affirmed. The court explained that here, the amicable conversation -- dominated by Defendant-- occurred in his mother’s home, a non-custodial atmosphere. The officer testified he did not know what the warrant was based on. Defendant fled only after the officer later told him he would be arrested, confirming that Defendant initially believed or at least hoped that he could avoid immediate arrest. Further, the court explained that even if Defendant was in custody, follow-up questions to clarify ambiguity do not amount to “interrogation” unless “their point is to enhance the defendant’s guilt.” The court concluded the district court did not err in denying Defendant’s motion to suppress. This is the latest proceeding in a long-running case regarding Indian fishing rights in certain waters in Washington State. This proceeding was instituted by three Indian tribes who sought a ruling that the recognized fishing rights of the Lummi Nation (“the Lummi”) under the 1974 decree do not extend to certain areas. The current dispute centers on a single line in the decree recognizing that “the usual and accustomed fishing places” in which the Lummi have fishing rights “include the marine areas of Northern Puget Sound from the Fraser River south to the present environs of Seattle, and particularly Bellingham Bay.” (“Final Decision I”). The question is whether the specific waters in dispute here—namely, the sheltered waters east of Whidbey Island and south of Fidalgo Island—fall within the Lummi’s historical fishing territory.   The Ninth Circuit affirmed the district court’s grant of summary judgment to the Swinomish Indian Tribal Community, Tulalip Tribes, and Upper Skagit Indian Tribe; dismissed as moot a cross-appeal filed by the Jamestown S’Klallam Tribe and Port Gamble S’Klallam Tribe (collectively, “S’Klallam”) from the district court’s grant of summary judgment; and dismissed as moot S’Klallam’s appeal of the district court’s denial of the S’Klallam’s motion for reconsideration. Applying the two-step inquiry, the panel concluded that the district court correctly held that the Swinomish, Tulalip, and Upper Skagit carried their burden to warrant a ruling, under Paragraph 25(a)(1) of the 1974 Decree, that Judge Boldt’s “determination of Lummi’s usual and accustomed fishing grounds and stations” did not extend to the disputed waters at issue here. This diversity suit involves personal injury and wrongful death claims arising from a collision between a sedan and a tour bus on a U.S. highway within the boundaries of the Navajo Nation reservation. Before trial, the district court held that Arizona law applies to the accident, and it therefore dismissed all claims based on Navajo law. At trial, the jury rejected all remaining claims asserted by the sedan’s surviving passengers and by the estate of the sedan’s driver, and the district court entered judgment in favor of the tour bus driver, the tour organizer, and other related corporations.   The Ninth Circuit affirmed the district court’s judgment in favor of Defendants to the extent that it dismissed all claims that had been asserted solely under Navajo law; reversed the district court’s judgment on the claims that were submitted for trial because the district court erroneously allowed the introduction of hearsay opinions of a non-testifying putative expert; and remanded for a new trial. The panel held that the district court abused its discretion in allowing, under the guise of impeachment evidence against Plaintiffs’ expert witnesses, Defendants’ counsel to elicit the opinions expressed in a police report prepared by the Arizona Department of Public Safety as to the cause of the accident. Next, the panel affirmed the district court’s conclusion that Arizona law applied and its resulting dismissal of all claims that were asserted only under Navajo law. View "JAMIEN JENSEN, ET AL V. Defendant-appellant Michael David Jackson was convicted and sentenced for several offenses stemming from the sexual abuse of his young niece, including two counts of possession of child pornography. On appeal Jackson argued, and the government conceded, that the possession convictions were multiplicitous and violated the Fifth Amendment’s Double Jeopardy Clause. To this the Tenth Circuit Court of Appeals agreed and therefore remanded to the district court with instructions to vacate one of these convictions. Jackson also challenged his sentence, contending: it was procedurally unreasonable because the application of several sentencing enhancements constituted impermissible double counting; and it was substantively unreasonable. The Tenth Circuit noted the district court will have discretion to consider the entire sentencing package on remand. The Court rejected these challenges and concluded that the sentence imposed was both procedurally and substantively reasonable. View "United States v. Jackson" on Justia Law

A district court conducted two hours of voir dire in a courtroom closed to the public and broadcasted live over an audio feed. After Defendant Quentin Veneno, Jr. objected, the district court concluded that the dangers of the COVID-19 pandemic justified its closure of the courtroom, but also provided a video feed for the rest of trial. Although Defendant objected to the initial audio-only feed after the initial two hours of voir dire, he never requested that the district court restart jury selection or moved for a mistrial. Defendant appealed both his conviction and challenged Congress’s constitutional authority to criminalize the conduct of Indians on tribal land, whether a previous conviction can be a predicate offense for 18 U.S.C. § 117(a)(1) convictions, and whether admission of other-act evidence met the rigors of Federal Rule of Evidence 404(b). Finding no reversible error, the Tenth Circuit affirmed the district court. View "United States v. Veneno" on Justia Law
