Before 2009, the Alaska Board of Game employed a controversial scoring system in order to distribute permits to subsistence hunters in a popular caribou and moose hunting area between Anchorage and Fairbanks. In 2009, the Board amended its regulations to abolish the scoring system and replace it with two separate subsistence hunts: a community harvest hunt for groups and a separate hunt for individuals. A local tribe was subsequently granted a community harvest permit pursuant to the new rules. An individual resident brought suit challenging the new system, alleging violations of the Alaska Administrative Procedure Act, his due process rights, the Board’s governing statutes, and several provisions of the Alaska Constitution. The tribe intervened on the side of the State and a private organization intervened on the side of the individual. In July 2010, the superior court granted summary judgment and enjoined the community harvest hunt as unconstitutional. The superior court later awarded attorney’s fees to the individual and private organization. The tribe appealed both decisions to the Supreme Court. Upon review, the Court concluded that the underlying appeal was moot because the challenged regulation had been substantively changed since 2009. Accordingly, the case was dismissed. View "Nene v. Plaintiff Automotive United Trades Organization brought suit against Washington State and its officials, challenging the constitutionality of disbursements the State gives to Indian tribes under fuel tax compacts. The trial court dismissed the amended complaint for failure to join indispensable parties, namely the Indian tribes party to the agreements, under CR 19. The Supreme Court reversed, holding the tribes were not indispensable parties under CR 19(b). Although the tribes are necessary parties under CR 19(a) whose joinder was not feasible due to tribal sovereign immunity, equitable considerations allowed this action to proceed in their absence. Paulette Kaleikini is a native Hawaiian who engages in traditional and customary practices, including the protection of native Hawaiian burial remains. Kaleikini brought suit against the City and County of Honolulu and the State of Hawai'i, challenging the approval of the Honolulu High-Capacity Transit Corridor Project. Kaleikini argued that the rail project should be enjoined until an archaeological inventory survey, which identifies and documents archaeological historic properties and burial sites in the project area, is completed for all four phases of the project. The City moved to dismiss Kaleikini’s complaint and/or for summary judgment, and the State joined in the motion. The City acknowledged that an archaeological inventory survey was required for each phase of the rail project. The City and State contended that as long as an archeological inventory survey had been completed for a particular phase, construction could begin on that part of the project even if the surveys for the other phases had not yet been completed. The Circuit Court of the First Circuit granted summary judgment in favor of the City and State on all of Kaleikini’s claims. Kaleikini appealed the circuit court’s final judgment in favor of the City and the State. Upon review, the Supreme Court concluded that the City and State failed to comply with State law pertaining to the surveys and its implementing rules when it concurred in the rail project prior to the completion of the required archaeological inventory survey for the entire project. The City similarly failed to comply with State law and its implementing rules by granting a special management area permit for the rail project and by commencing construction prior to the completion of the historic preservation review process. Accordingly, the Supreme Court vacated the circuit court’s judgment on Counts 1 through 4 of Kaleikini’s complaint and remanded the case to the circuit court for further proceedings on those counts. An employee of a tribal enterprise sought to invoke the jurisdiction of the Oklahoma Workers' Compensation Court. Petitioner John A. Waltrip fell on a patch of ice while working as a surveillance supervisor at a casino and injured primarily his right shoulder. Petitioner initially obtained treatment from his personal physician but Tribal First, the employer Osage Million Dollar Elm Casino's claim administrator, sent him to an orthopedic specialist who recommended surgery in 2009. Petitioner filed a claim in the Oklahoma Workers' Compensation Court on July 17, 2009, seeking medical treatment and temporary total disability. The Casino and Insurer Hudson Insurance Company asserted that court lacked jurisdiction based on the tribe's sovereign immunity. A hearing was held solely on the jurisdictional issue; the Workers' Compensation Court denied jurisdiction and dismissed the claim holding that the tribe enjoyed sovereign immunity and that the provisions of the tribe's workers' compensation policy did not subject the insurance company to liability for claims in state court. The Court of Civil Appeals affirmed and the Supreme Court granted certiorari review. Upon review, the Supreme Court held that: (1) the tribe enjoyed sovereign immunity and was not therefore subject to the jurisdiction of the Oklahoma Workers' Compensation Court; and (2) the workers' compensation insurer did not enjoy the tribe's immunity and was estopped to deny coverage under a policy for which it accepted premiums computed in part on the employee's earnings.View "Waltrip v. M.A.S. (Father) appealed the termination of his parental rights to P.S.E. At the time P.S.E. was removed from Mother’s care, Father lived in California and did not know he had a child in South Dakota. The Indian Child Welfare Act (ICWA) applied to these proceedings because P.S.E. was an enrolled member of the Fort Peck Sioux Tribe. Father argued on appeal that the Department of Social Services (DSS) did not make active efforts to reunite the Indian family and that any efforts made were successful. Because the evidence presented shows that DSS provided active and reasonable, though abbreviated, efforts to place P.S.E. with Father, and those efforts were unsuccessful, the Supreme Court affirmed the trial court's order terminating Father's parental rights.View "In the interest of P.S.E." on Justia Law

"Jade" is the biological daughter of Roy and Sheila. Jade is an Indian child as defined in the Indian Child Welfare Act (ICWA). Between 1998 and 2007, the Office of Children's Services (OCS) received at least 12 reports of drug abuse and child neglect in the family. Before Jade's birth in September 2004, the couple's older children were transferred to OCS custody for two years. Roy and Sheila attempted to complete drug treatment programs but were unsuccessful. Sheila relapsed while pregnant with Jade; her discharge report from the treatment program indicated she tested positive for cocaine in August 2005 and stopped attending treatment sessions or contacting drug counselors in October 2005. Roy was discharged for positive drug tests and missing treatment. Since being taken into OCS custody in July 2008, Jade has lived in five separate placements. In its termination order, the superior court found that termination of parental rights was in Jade's best interests and that OCS made active efforts to prevent the breakup of the Indian family. Roy contested three of the superior court's findings: that OCS made active efforts to prevent the breakup of the family; that termination was in Jade's best interests; and that good cause existed to deviate from the ICWA placement preferences. Sheila did not appeal the superior court's decision. Upon review, the Supreme Court found that the record supported the superior court's conclusions with regard to OCS's efforts to keep the family together, and that it was in Jade's best interests to terminate Roy's parental rights.View "Roy S. v. A father appealed the termination of his parental rights to his daughter, an Indian child within the meaning of the Indian Child Welfare Act (ICWA). He challenged the superior court's findings that the Office of Children's Services (OCS) made active efforts to prevent the breakup of his Indian family, arguing that OCS failed to investigate placement with his extended family members and did not provide him with adequate visitation and remedial services. In combined cases, the Supreme Court examined the Indian Child Welfare Act (ICWA) to decide whether several issues relating to the Act's notice provision mandate notice be sent to the appropriate tribe or to the Secretary of the Interior. Because the question of whether notice violations occurred in these cases began with determining whether the tribal-notice requirement was triggered, the Court first considered what indicia of Indian heritage sufficed to trigger the notice requirement. Further, the Court then considered whether a parent could waive the rights granted by ICWA to an Indian child's tribe and determine the appropriate recordkeeping requirements necessary to document the trial court's efforts to comply with ICWA's notice provision. "While it is impossible to articulate a precise rule that will encompass every possible factual situation, in light of the interests protected by ICWA, the potentially high costs of erroneously concluding that notice need not be sent, and the relatively low burden of erring in favor of requiring notice, we think the standard for triggering the notice requirement of 25 USC 1912(a) must be a cautionary one." Upon review, the Supreme Court held that: (1) sufficiently reliable information of virtually any criteria on which tribal membership might be based suffices to trigger the notice requirement; (2) a parent of an Indian child cannot waive the separate and independent ICWA rights of an Indian child's tribe and that the trial court must maintain a documentary record; and (3) the proper remedy for an ICWA-notice violation is to conditionally reverse the trial court and remand for resolution of the ICWA-notice issue.View "In re J.L. Six tribal councils, joined by two other associations, filed an action against the State of Alaska, Department of Natural Resources (DNR) in the superior court seeking a declaratory judgment that the 2005 Bristol Bay Area Plan (BBAP, the Plan) was unlawful. DNR’s motion to dismiss under Civil Rule 12(b)(6) was denied and the superior court held that: (1) the BBAP is a regulation that must be promulgated under the Alaska Administrative Procedure Act (APA), and (2) Alaska Appellate Rule 602(a)(2) does not bar the Tribes’ claims. Upon review, the Supreme Court concluded that Appellate Rule 602(a)(2) did not bar the Tribe's claims and the that BBAP is not a regulation.View "Alaska Dept. of Natural Resources v. Michael McCrary sued Ivanof Bay Village (Ivanof Bay) and its president, Edgar Shangin, under two contracts, alleging breaches of the implied covenants of good faith and fair dealing. The superior court dismissed the suit based on sovereign immunity. McCrary appealed the sovereign immunity ruling, arguing that even though the United States Department of Interior lists Ivanof Bay as a federally recognized Indian tribe, Ivanof Bay has not been formally designated as a federally recognized tribe. The Supreme Court previously concluded Alaska Native tribes recognized by Congress or the Executive Branch are sovereign under federal law, and McCrary did not demonstrate that conclusion should be overturned.
