The Supreme Court reversed the order of the district court terminating Father’s parental rights to his two children, holding that the district court correctly determined to proceed as if the children were Indian children and the Indian Child Welfare Act applied, but the court erred in failing to make specific findings about how or if the facts of the case met the “active efforts” required by clear and convincing evidence prior to removal and beyond a reasonable doubt prior to termination.The district court’s order found that children were Indian children, but neither transcripts nor written orders discussed how the Department of Public Health and Human Services made “active efforts” before removal and before termination. The Supreme Court vacated the district court’s order and remanded the matter for the court to document in detail if the Department met its burden of providing “active efforts” by clear and convincing evidence prior to removal and beyond a reasonable doubt prior to termination pursuant to 25 U.S.C. 1912(d) and 25 CFR 23.2. Shane Martin appealed an order denying his N.D.R.Civ.P. 60(b) motion for relief from default judgment. Martin was the biological father of Cheri Poitra's child, I.R.P. Martin and Poitra were unmarried tribal members of the Turtle Mountain Band of Chippewa. In August 2017, Poitra began receiving services from Bismarck Regional Child Support Unit (BRCSU). The State sought to establish a child support obligation from Martin and served him with a summons and complaint. Martin completed a financial affidavit and returned it to BRCSU on October 8, 2017, but did not file an answer or other responsive pleading. On November 7, 2017, the State filed a N.D.R.Ct. 3.2 motion for default judgment. More than 21 days had passed since Martin was served and he had appeared but had not filed an answer or other responsive pleading. On November 17, 2017, Martin filed a notice of special appearance. The notice of special appearance did not contain an accompanying affidavit, motion, request for action, or response to the allegations. Instead, the notice stated only that Martin's attorney was entering a special appearance to contest "both subject matter and personal jurisdiction." Included with the notice was a copy of a summons and a petition for custody filed by Martin with the Turtle Mountain Tribal Court on November 16, 2017. A hearing on the "notice of special appearance" was held January 2018. During the hearing, the district court stated numerous times that the notice was not a motion on which the court could act and instructed Martin to file a motion. In February, 2018, the district court entered its findings of fact, conclusions of law, and order for judgment finding Martin in default. Judgment was entered February 21, 2018. Martin argues that his return of the financial affidavit and filing of a notice of special appearance was sufficient to preclude a default judgment under N.D.R.Civ.P. 55(a) and thus the district court erred in denying his Rule 60(b) motion. The North Dakota Supreme Court affirmed: the district court did not err in denying a Rule 60(b) motion for relief from judgment where Martin was properly provided notice and served with the motion for default judgment. The Supreme Court affirmed the dispositional order terminating Father’s parental rights of his four-year-old son (Child) in this Indian Child Welfare Act case, holding that there was no trial court error in terminating Father’s parental rights.In terminating Father’s parental rights, the trial court found that Father failed to act as a caregiver to Child and that his and Mother’s continued custody of Child would likely resolution in serious emotional or physical damage to them. In addition, the court concluded that active efforts were made to prevent the breakup of the family but were unsuccessful and that termination of all parental rights was the least restrictive alternative in the children’s best interests. The Supreme Court affirmed, holding (1) Father's argument that the South Dakota Department of Social Services failed to make active efforts to prevent the breakup of his Indian family was without merit; and (2) therefore, the trial court properly terminated Father’s parental rights. The Supreme Court reversed the order of the district court terminating Mother’s parental rights to her two children, holding that the district court erred when it proceeded with termination of Mother’s parental rights before it had a conclusive determination of the children’s status in the Chippewa Cree Tribe and when it did not address whether the Department of Public Health and Human Services made “active efforts” to prevent the breakup of the Indian family and that those efforts were unsuccessful.Specifically, the Court held (1) where the district court had reason to believe that the children may be eligible for enrollment in the Chippewa Cree Tribe, the court failed to satisfy the threshold requirement of the Indian Child Welfare Act to verify the children’s eligibility; (2) the district court did not err when it did not address whether the Department provided “active efforts” pursuant to 25 U.S.C. 1912(d); and (3) Mother’s due process were not violated when the Department raised the issue of abandonment during closing arguments at the termination hearing and Mother’s counsel did not object. Mother and Father appealed the juvenile court's order terminating their parental rights to their children. The Court of Appeal held that the juvenile court had jurisdiction under the Uniform Child Custody Jurisdiction Enforcement Act (UCCJEA) after a Nevada juvenile court declined to exercise jurisdiction. The court conditionally reversed and remanded, holding that the investigation required by the Indian Child Welfare Act (ICWA) was not complete. In this case, HSA conceded that it had not substantially complied with the ICWA notice requirements, the order terminating parental rights should be vacated, and reversal was required to determine the applicability of the ICWA. A mother appealed the termination of her parental rights to her son, an Indian child. She argued the trial court violated the Indian Child Welfare Act (ICWA) by finding that the Office of Children’s Services (OCS) made active efforts and that her continued custody of her son was likely to result in serious emotional or physical damage to him. She also argued that the trial court’s latter finding was not supported by the testimony of a qualified expert as required by ICWA. Defendant-appellant, S.A. (Mother), appealed the termination of her parental rights to N.G., a boy born in 2005. She argued the juvenile court erroneously failed to ensure that plaintiff-respondent, Riverside County Department of Public Social Services (DPSS), fully investigated N.G.’s paternal lineal ancestry and gave adequate notices of the proceedings to all federally recognized Cherokee tribes and to the Bureau of Indian Affairs (BIA), pursuant to the Indian Child Welfare Act (ICWA) and related California law. After review, the Court of Appeal agreed Mother’s claim had merit and conditionally reversed the judgment. The Court also concluded that DPSS had to be ordered to further investigate N.G.’s paternal lineal ancestry, and include any newly discovered information concerning N.G.’s paternal lineal ancestry in the ICWA notices to all federally recognized Cherokee tribes, the BIA, and all previously noticed tribes. DPSS was also ordered to inquire whether N.G. may have maternal lineal ancestry and, if so, send additional ICWA notices, as appropriate. View "In re N.G." on Justia Law

Appellant, the noncustodial biological father of the minor K.L., appealed the juvenile court’s dispositional judgment, removing the minor from his mother and placing him with his presumed father, L.V. In August 2014, the Siskiyou County Health and Human Services Agency filed a section 300 petition on behalf of the two-year-old minor and his older half sibling, after mother was arrested for child cruelty and possession of a controlled substance. Shortly after the minor was born, L.V. took the minor into his home where he lived for several months. Initially, L.V. believed he was quite probably the minor’s father and treated him as such. A DNA test, requested by mother, confirmed L.V. was not the minor’s biological father. Nonetheless, L.V. continued to treat the minor as his own. The juvenile court found L.V. to be the minor’s presumed father. The Agency thereafter placed the minor and his half sibling with L.V. Shortly after these proceedings commenced, paternity test results revealed appellant to be the minor’s biological father. Appellant had never met the minor and had only recently learned of the minor’s existence. Appellant was an enrolled member of the federally recognized Karuk Indian Tribe . The Karuk Indian Tribe intervened on appeal, contending the juvenile court failed to comply with the procedural requirements of the Indian Child Welfare Act of 1978 ("ICWA") in entering its dispositional judgment. The Court of Appeal found the provisions of ICWA did not apply in this case and affirmed the juvenile court's judgment. View "In re K.L." on Justia Law

Sally H. (Mother) appealed a judgment terminating her parental rights to her child, E.H. Mother's sole claim on appeal was that the juvenile court erred in terminating her parental rights because the court failed to ensure that the San Diego County Health and Human Services Agency (Agency) fully complied with the inquiry and notice requirements of the Indian Child Welfare Act of 1978 and related law. Among other alleged errors, Mother contended the Agency failed to fulfill its duty to inquire of E.H.'s maternal great-grandmother, Sally Y.H., in order to obtain identifying information pertaining to Sally Y.H.'s father, and failed to provide notice of such information to an Indian tribe named the Tohono O'odham Nation. Mother further contended the failure to provide notice of Sally Y.H.'s father's identifying information to the Tohono O'odham Nation was prejudicial because he was likely the source of E.H.'s possible American Indian heritage. The Court of Appeal agreed with Mother that, considering Sally Y.H.'s statement to the Agency that her paternal family had Tohono O'odham Nation heritage, the Agency had a duty to attempt to obtain Sally Y.H.'s father's identifying information and to provide notice of any such information obtained to the Tohono O'odham Nation. If Bruno Y. was Sally Y.H.'s father, and E.H.'s great-great-grandfather, the Agency failed to properly describe his ancestral relationship to E.H. on the notice provided to the Tohono O'odham Nation. Finally, given that Sally Y.H. told the Agency that her paternal family had heritage from the Tohono O'odham Nation, the Court could not conclude the Agency's errors were harmless. Accordingly, the trial court judgment was reversed for the limited purpose of having the Agency provide the Tohono O'odham Nation with proper notice of the proceedings in this case. The Supreme Court affirmed the order of the district court terminating the parental rights of A.M., the putative father of P.T.D., holding that the district court was not required to comply with the requirements of the Indian Child Welfare Act (ICWA) when terminating A.M.’s parental rights.After P.T.D. was removed from Mother’s custody, the Department of Public Health and Human Services, Child and Family Services Division identified P.T.D. as an Indian child subject to the ICWA. See 25 U.S.C. 1912. Later, the Department filed a petition to terminate A.M.’s parental rights as P.T.D.’s putative father. By that time, P.T.D. had been in foster care for nearly two years, and A.M. had no meaningful contact with P.T.D., nor had he established a relationship with the child. The district court determined that termination of A.M.’s parental rights was in P.T.D.’s best interest. The Supreme Court affirmed, holding that the requirements of ICWA were inapplicable to the facts of this case and that the district court’s decision to terminate A.M.’s parental rights was not clearly erroneous.
