Gerald Magnant and John Davis were each charged with violating MCL 205.428(3) of the Michigan Tobacco Products Tax Act (the TPTA), for transporting 3,000 or more cigarettes without the transporter’s license required by MCL 205.423(1). Defendants were nonsupervisory employees of the Keweenaw Bay Indian Community (KBIC). Michigan State Police pulled over a KBIC-owned pickup truck for speeding. Davis was driving, and consented to a search of a utility trailer, representing to the trooper that it contained “supplies” and “chips.” The trailer actually contained 56 cases holding over 600,000 “Seneca” cigarettes marked with KBIC stamps but not with the Michigan Department of Treasury tax stamps required by the TPTA. Magnant was a passenger, and admitted he helped load the trailer. The parties stipulated that Davis, Magnant, and the KBIC were not licensed to transport tobacco products under the TPTA. Defendants jointly moved to dismiss the charges, arguing that the relevant statutes were unconstitutionally vague because they did not give individual employees, as opposed to businesses, adequate notice that they were subject to the TPTA licensing requirement for transporting cigarettes. A circuit court denied the motion, holding that the language of the TPTA provided adequate notice that an “individual” can be a “transporter” subject to the licensing requirement. The Michigan Supreme Court held that an individual acting as a “transporter” need not have specific awareness of the law that creates the licensing requirement; a conviction for violating MCL 205.428(3) must, at a minimum, be supported by a showing that the individual (1) knew he or she was transporting a regulated amount of cigarettes and (2) knew of facts that conferred “transporter” status upon him or her. In this case, however, the prosecution failed to present any evidence establishing or implying that defendants were aware of facts that conferred transporter status on them. A member of the Metlakatla Indian Community was convicted of several commercial fishing violations in State waters and fined $20,000. He appealed his conviction and sentence to the court of appeals, which asked the Alaska Supreme Court to take jurisdiction of the appeal because of the importance of the primary issue involved: whether the defendant’s aboriginal and treaty-based fishing rights exempted him from State commercial fishing regulations. The defendant also challenged several evidentiary rulings and the fairness of his sentence. Because the Supreme Court held the State had authority to regulate fishing in State waters in the interests of conservation regardless of the defendant’s claimed fishing rights, and because the Court concluded the trial court did not abuse its discretion in its procedural rulings, the Supreme Court affirmed the conviction. The Court also affirmed the sentence as not clearly mistaken, except for one detail on which the parties agreed: the district court was mistaken to include a probationary term in the sentence. Charles Williams was a Colorado prisoner who practiced a Native American religion that used tobacco in sweat lodges. The ceremonies were possible because prison officials specified where inmates could use tobacco in religious services. In 2018, prison officials confiscated tobacco from a prisoner and suspected that it had come from Williams’s religious group. Prison officials responded with a 30-day ban on the use of tobacco for religious services. Weeks later, prison officials imposed a lockdown and modified operations, including an indefinite suspension of Native American religious services. Despite this suspension, prison officials allowed Christian and Islamic groups to continue their religious services because outside volunteers could provide supervision. The complaint implied that the suspension lasted at least nine days. Williams sued under 42 U.S.C. 1983, alleging in part that prison officials violated the First Amendment. The defendants moved to dismiss, asserting qualified immunity. The district court denied the motion on the ground that Williams’s allegations had overcome qualified immunity. The Tenth Circuit concurred: because Williams adequately alleged the violation of a clearly established constitutional right, he has overcome qualified immunity. So the denial of the defendants’ motion to dismiss was affirmed. View "Williams v. Borrego" on Justia Law

Appellant Iris Stacy (Mother) sought certiorari review of an unpublished opinion by the Oklahoma Court of Civil Appeals (COCA) that affirmed the trial court's judgment terminating her parental rights to I.T.S., I.M.S., and R.E.S. (Children). At issue was the trial court's sua sponte discharge of Mother's court-appointed counsel at the conclusion of the disposition hearing, which left her without representation until State filed its petition to terminate her parental rights over two years later. She argued the trial court's failure to provide her legal representation between the disposition and the filing of the petition to terminate her parental rights (a period of 798 days) was contrary to the federal Indian Child Welfare Act (ICWA). The Oklahoma Supreme Court granted her petition to address a question of first impression: Upon request by an Indian child's parent for counsel in a deprived child proceeding, and a finding of indigency, whether the federal Indian Child Welfare Act (ICWA) required court-appointed counsel for the parent at all stages of the deprived child proceeding. The Supreme Court held that section 1912(b) of ICWA required, upon request and a finding of indigency, the appointment of counsel at all stages of the deprived child proceeding. Defendant-Appellant Eric Martinez appealed a district court’s imposition of a 27-month sentence for his burglary conviction under the Indian Major Crimes Act. In February 2016, Martinez and two accomplices burglarized a residence within the boundaries of the Navajo Nation in McKinley County, New Mexico. During the burglary, Martinez used a hammer to break a hole in the front door near the doorknob to gain entry to the residence. He and his accomplices took valuable items from the residence, including electronics, jewelry, and ceremonial shawls and robes. Martinez ultimately pled guilty to an “assimilated” New Mexico burglary offense under N.M. Stat. Ann. 30-16-3. At sentencing, Martinez argued that federal law permitted the district court to impose a conditional discharge, which would allow a term of probation without entry of a judgment of conviction -- a sentence possible had his case been adjudicated in New Mexico state court. He also objected to a two-level sentencing enhancement under U.S.S.G. 2B2.1(b)(4) for possessing a dangerous weapon on the basis that he did not use the hammer as a weapon during the burglary. The district court rejected these arguments. Finding no reversible error, the Tenth Circuit affirmed Martinez’s conviction and sentence. View "United States v. Martinez" on Justia Law

Defendant Paddy Platero pleaded guilty to a charge of “[a]busive sexual contact” with a child under 12 in Indian country. In computing Defendant’s guideline sentencing range, the United States District Court for the District of New Mexico increased his base offense level on the ground that “the offense involved conduct described in 18 U.S.C. [section] 2241(a) or (b).” Defendant read the guideline as requiring a violation of section 2241(a) or (b). Section 2241 defined the offense of aggravated sexual abuse, not the lesser offense of abusive sexual contact of which Defendant was convicted. Defendant therefore appealed his sentence, contending that his base offense level should not have been increased. The Tenth Circuit rejected Defendant’s reading of Guideline 2A3.4(a)(1): “In context, the only reasonable interpretation of the guideline is that the reference to “conduct described in 18 U.S.C. 2241(a) or (b)” is a reference to the conduct described in [section] 2241 that distinguishes aggravated sexual abuse, which is governed by that section, from sexual abuse in general, which is governed by [section] 2242. Defendant’s interpretation of USSG 2A3.4(a)(1) must be avoided because it would eliminate any possible application of the provision, rendering it useless; and our interpretation finds support in both the history of 2A3.4(a)(1) and the statutory scheme, which sets penalties for the various types of abusive sexual contact set forth in section 2244 by reference to the conduct that distinguishes from one another the various types of sexual abuse prohibited by [sections] 2241, 2242, and 2243 – that is, by reference to the various means employed to commit sexual abuse.” View "United States v. On May 15, 1915, the State of Washington charged Alec Towessnute, a Yakama tribal member, with multiple fishing crimes. These criminal charges stemmed from the fact that he was fishing in the usual and accustomed waters of the Yakama tribe the day before without a state-issued fishing license using an unpermitted fishing hook. The parties stipulated that the United States had entered into a treaty with the Yakama Nation on June 9, 1855 (ratified by the United States Senate on March 8, 1859), and that the area where Mr. Towessnute fished “has been used and enjoyed by said Indians during the fishing season of each and every year since said treaty was made; that said fishing place has from time immemorial been used and enjoyed by said Indians and their ancestors and known by the Indian name of ‘Top-tut’.” Mr. Towessnute objected to the charges. Relying on the stipulation, he explained that Benton County had no jurisdiction over the matter because he had committed no crime by exercising his treaty fishing rights. The trial court judge agreed: on June 10, 1915, Benton County Superior Court entered a final judgment in the matter, dismissing all the charges against Mr. Towessnute. The 1916 Washington Supreme Court reversed, mandating that the criminal charges be reinstated, overruling Mr. Towessnute’s objections. In 2015, the descendants of Mr. Towessnute sought vacation of any record of conviction against Mr. Towessnute. Given that such a conviction could not be proved by the record, the trial court declined to take any action. Under the Rules of Appellate Procedure (RAP) 1.2(c), the 2021 Washington Supreme Court acted to waive any of the RAP “to serve the ends of justice.” The mandate issued by the Washington Supreme Court in 1916 was recalled and any conviction existing then or now against Mr. Towessnute was vacated. In this case, the en banc court considered the constitutionality of the Indian Child Welfare Act (ICWA), 25 U.S.C. 1901 et seq., and the validity of implementing regulations promulgated by the Bureau of Indian Affairs (BIA) in its 2016 Final Rule (Final Rule). The district court granted plaintiffs summary judgment in part, declaring that the ICWA and the Final Rule contravene multiple constitutional provisions and the Administrative Procedure Act (APA). After defendants appealed, a panel of this court reversed and rendered judgment for defendants. The en banc court then reconsidered the case.The en banc court unanimously held that at least one plaintiff has standing to challenge Congress's authority under Article I of the Constitution to enact ICWA and to press anticommandeering and nondelegation challenges to specific ICWA provisions, and that plaintiffs have standing to challenge the Final Rule as unlawful under the APA. The en banc court is equally divided as to whether plaintiffs have standing to challenge two provisions of ICWA, 25 U.S.C. 1913 and 1914, on equal protection grounds, and the district court's conclusion that plaintiffs can assert this claim is therefore affirmed without a precedential opinion. An en banc majority also held that plaintiffs have standing to assert their equal protection challenges to other provisions of ICWA.On the merits, the en banc majority agrees that, as a general proposition, Congress had the authority to enact ICWA under Article I of the Constitution, and that the ICWA's "Indian child" classification does not violate equal protection. The en banc court is equally divided, however, as to whether plaintiffs prevail on their equal protection challenge to ICWA's adoptive placement preference for "other Indian families," and its foster care placement preference for a licensed "Indian foster home." An en banc majority held that ICWA's "active efforts," section 1912(d), expert witness, section 1912(e) and (f), and recordkeeping requirements, section 1915(e), unconstitutionally commandeer state actors. However, the en banc court is equally divided on whether the placement preferences, section 1915(a)–(b), violate anticommandeering to the extent they direct action by state agencies and officials; on whether the notice provision, section 1912(a), unconstitutionally commandeers state agencies; and on whether the placement record provision, section 1951(a), unconstitutionally commandeers state courts.Furthermore, an en banc majority held that several challenged ICWA provisions validly preempt state law and so do not commandeer states, and that section 1915(c) does not violate the non-delegation doctrine. Finally, an en banc majority held that the BIA did not violate the APA by concluding in the Final Rule that it may issue regulations binding on state courts. However, an en banc majority also held that the Final Rule violated the APA to the extent it implemented these unconstitutional provisions and that 25 C.F.R. 23.132(b) violated the APA. An en banc majority held that the Final Rule did not violate the APA in any other respect. Accordingly, the en banc court affirmed in part, reversed in part, and rendered judgment accordingly. The Oklahoma Supreme Court previously declared that certain tribal gaming compacts the Oklahoma Executive branch entered into with the Comanche and Otoe-Missouria Tribes were invalid under Oklahoma law because the gaming compacts authorized certain forms of Class III gaming prohibited by state law. While "Treat I" was pending before the Supreme Court, the Executive branch entered into two additional compacts with the United Keetoowah Band of Cherokee Indians and the Kialegee Tribal Town. The parties to the compacts submitted the tribal gaming compacts to the United States Department of the Interior, and the Department of the Interior deemed them approved by inaction, only to the extent they are consistent with the Indian Gaming Regulatory Act (IGRA). The Oklahoma Supreme Court determined these new compacts were also not valid: for the new compacts to be valid under Oklahoma law, the Executive branch must have negotiated the new compacts within the statutory bounds of the Model Tribal Gaming Compact (Model Compact) or obtained the approval of the Joint Committee on State-Tribal Relations. Without proper approval by the Joint Committee, the new tribal gaming compacts were invalid under Oklahoma law. View "Treat v. Stitt" on Justia Law

The Ninth Circuit filed: (1) an order amending its opinion, denying a petition for panel rehearing, and denying on behalf of the court a petition for rehearing en banc; and (2) an amended opinion reversing the district court's dismissal for lack of standing of a tribal health organization's action seeking declaratory relief regarding alleged violations of a federal law concerning the provision of health services to Alaska Natives.The panel concluded that SCF alleges an injury in fact in two distinct ways: first, that ANTHC infringed SCF's governance and participation rights under Section 325 of the Department of the Interior and Related Agencies Appropriations Act of 1998 by delegating the full authority of the fifteen-member Board to the five-person Executive Committee; and second, that ANTHC erected informational barriers in the Code of Conduct and Disclosure Policy that deprived SCF of its ability to exercise effectively its governance and participation rights.
